This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application refers to Oojrah, the software program provided by the Company.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Oojrah, Aden, Yemen.
  • Country refers to: Yemen
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Passenger Agreement

Between the First Party: Oojrah Platform ("the Platform") and the Second Party: the User ("Passenger").

1. Nature of the Service

  • 1.1 Oojrah provides a technology platform that connects passengers with transportation providers (drivers) through its mobile application.
  • 1.2 Oojrah does not provide transportation services directly; it facilitates access to independent drivers.

2. Terms of Using the Application

  • 2.1 The user must be at least 18 years old and legally eligible to enter into contracts.
  • 2.2 Accurate and complete information must be provided during registration, and account credentials must be kept confidential.
  • 2.3 The application is for personal use only and not for commercial purposes or resale.

3. Payment and Fees

  • 3.1 Trip cost is calculated based on distance, time, and local pricing policy.
  • 3.2 The passenger agrees to automatic fare deduction via their linked payment method (e.g., credit card, Apple Pay, etc.).
  • 3.3 Additional charges may apply such as cancellation fees, waiting fees, delivery fees, etc.

4. Prohibited Behavior

  • 4.1 The application may not be used for any illegal or unethical activity.
  • 4.2 Passengers must respect drivers and not cause harm or damage to their property.
  • 4.3 Oojrah reserves the right to suspend or cancel user accounts that violate policies or receive frequent complaints.

5. Cancellation Policy

  • 5.1 Trips can be canceled at any time, but a cancellation fee may apply if the driver has already accepted the ride.
  • 5.2 If the passenger does not appear at the pickup location within the specified time, the trip is considered “canceled by passenger” and cancellation fees may apply.

6. Privacy and Data

  • 6.1 Oojrah collects certain personal data (location, payment details, trip history, etc.) to improve its service.
  • 6.2 The company is committed to protecting user data in accordance with its published privacy policy.

7. Limitation of Liability

  • 7.1 Oojrah is not responsible for the actions of drivers or incidents occurring during trips as drivers are independent contractors.
  • 7.2 The company’s maximum liability, if any, is limited to the amount of the trip in question.

8. Governing Law and Jurisdiction

  • 8.1 This agreement is governed by the laws of Yemen.
  • 8.2 Any dispute shall be settled by the competent courts in Aden.

9. Consent

By clicking "Agree" or "Register", the user acknowledges having read, understood, and agreed to all the terms and conditions stated above.

Driver Service Agreement

Between the First Party: Oojrah Platform ("the Platform") and the Second Party: the Driver ("Service Provider").

1. Nature of the Relationship

  • 1.1 The relationship between both parties is an independent contractual relationship and not an employment contract.
  • 1.2 The driver operates on a freelance basis and is free to choose their working hours.
  • 1.3 Oojrah is not responsible for any type of insurance related to the driver.
  • 1.4 The driver must comply with platform instructions and update personal data in case of changes.

2. Scope of Work

  • 2.1 The driver will use the Oojrah app to provide transportation services to passengers.
  • 2.2 The vehicle must be licensed, insured, and meet safety requirements.
  • 2.3 The driver must comply with traffic laws and state regulations.
  • 2.4 The driver must operate only within the city of Aden and is not allowed to travel outside the city for service.
  • 2.5 The driver must not make direct arrangements with customers outside the platform; doing so is considered a serious breach of the contract.
  • 2.6 The driver must maintain the vehicle's cleanliness, conduct regular maintenance, and hold a valid driver’s license and car documentation throughout the service period.
  • 2.7 The driver must appear at the agreed time and location with the customer and provide professional and safe service.

3. Fees and Payments

  • 3.1 The driver is entitled to earnings based on the pricing and commission policy announced in the Oojrah app.
  • 3.2 Oojrah has the right to deduct its agreed commission from each trip’s fare.
  • 3.3 Payments are disbursed weekly (on Thursdays) based on the applicable payment cycle.
  • 3.4 The driver must deposit collected cash amounts to the company's account weekly (on Wednesdays).

4. Contract Duration and Termination

  • 4.1 The contract begins upon signing and continues indefinitely until terminated by either party.
  • 4.2 Oojrah reserves the right to terminate the contract at any time, with prior notice or immediately in case of violation.

5. Legal Liability

  • 5.1 The driver is responsible for any damages or legal violations occurring during service.
  • 5.2 Oojrah is not liable for accidents or damages caused by the driver while using the vehicle or providing the service.

6. General Provisions

  • 6.1 The driver acknowledges having read and understood all the terms and conditions of Oojrah's platform.
  • 6.2 This contract is governed by the laws and regulations of the Republic of Yemen.
  • 6.3 Disputes shall be resolved amicably; if unresolved, they will be referred to the competent courts.
